Brain Quintenz to Resign from Kalshi’s Board Upon Taking Office as CFTC Commissioner
Brain Quintenz, the nominee to lead the Commodity Futures Trading Commission (CFTC) under President Trump, has recently announced his decision to resign from his position on the board of Kalshi, a prediction market platform, once he assumes his new role.
In a letter addressed to John Einstman, the designated agency ethics official for the CFTC, Quintenz stated, “Upon confirmation, I will resign from my position with KalshiEx.” He also mentioned his intention to relinquish all shares and unvested stock options he holds in the platform.
Quintenz emphasized in his letter, “I will forfeit all KalshiEx stock options that are unvested at the time of my resignation. I will divest any vested stock options and stock in KalshiEx as soon as practicable, but not later than 90 days after my confirmation.”
Furthermore, he committed to refraining from involvement in any matters related to Kalshi for at least the first year of his tenure. Quintenz stated, “For a period of one year after my resignation, I will not participate personally and substantially in any particular matter involving specific parties in which I know KalshiEx is a party or represents a party.”
CFTC’s Stance on Sports Betting
Despite mounting pressure from state regulators and sports leagues urging action, the CFTC has not made any official statements regarding Kalshi’s expansion into sports betting markets. When Quintenz assumes office, he will be the only active commissioner out of five seats, as the others have either departed or are planning to do so.
Under new leadership, the CFTC has shown signs of supporting the growth of prediction markets. In a previous incident during the Biden administration, the CFTC had directed Kalshi to remove its US president market. However, after Kalshi reinstated the market following a legal battle, it gained popularity among bettors.
This development allowed Americans to legally bet on election outcomes for the first time, prompting the CFTC to withdraw its legal challenge and potentially open the door for future election betting. Notably, a candidate for California Governor, Kyle Langford, recently placed a wager on himself to win.
Kalshi’s Expansion and Success in Sports Markets
With the rising demand for election markets, Kalshi has also broadened its sports betting offerings this year. In the past, the company limited markets to futures, but now users can predict outcomes of single matches in NBA, NFL, MLB, and NHL. Additionally, they introduced a variety of March Madness markets in NCAA basketball, attracting over $400 million in trading volume.
Last month, Kalshi reported $86 million in trades on the Masters tournament. Overall, the platform processed approximately $1.97 billion in trading volume in 2024, a significant increase from $183 million in 2023. This figure is expected to grow further this year, given the trading activity in sports markets.
Sports markets now constitute over 75% of all markets on Kalshi, a development that has drawn criticism from tribal sportsbooks and state regulators. Seven states have issued cease-and-desist orders to the platform, prompting Kalshi to initiate legal action in New Jersey, Nevada, and Maryland, with plans to do so in other states.
Despite challenges, Kalshi has secured favorable rulings in New Jersey and Nevada, allowing operations to continue. With Brain Quintenz poised to lead the CFTC, it appears that future challenges to Kalshi’s operations may face an uphill battle.
