The CFTC to Discuss Online Betting with Tribal Leaders in Conference Call
The Commodity Futures Trading Commission (CFTC) has arranged a conference call on May 29 with tribal betting leaders to address the current state of sports prediction markets. This comes after the cancellation of a planned roundtable at the end of this month, where stakeholders such as state regulators, tribal leaders, and sports leagues were supposed to convene.
Sports Prediction Markets Threatening Tribal Economies
The National Tribal Gaming Commissioners & Regulators have reached out to the CFTC regarding the proliferation of prediction markets in sports. They have expressed concerns about companies like Kalshi and Crypto.com, stating that these unregulated sports betting contracts are diverting substantial revenues from tribal economies. This undermines investments in legal compliance and poses a threat to tribal governments’ ability to serve their communities.
Kalshi, in particular, has expanded its sports markets to include NBA, NHL, NFL, and MLB match-winner markets, accounting for over 75% of its trading volume. Despite this growth, prediction markets still only generated around $23 million in revenue last year.
Challenges Faced by Tribal Sportsbooks
Many states, including Florida, Maine, New Mexico, Minnesota, Washington, and Wisconsin, have granted exclusive rights over sports betting to state tribes. However, the rise of prediction markets presents a challenge to these tribal sportsbooks, especially in states with no regulated online betting, such as California.
The California Nations Indian Gaming Association (CNIGA) has voiced strong opposition to the trading of sports contracts, stating that it violates state and federal law and interferes with tribes’ sovereign right to regulate gaming within their territories.
The Dominance of Commercial Sportsbooks
While tribes have exclusive deals in certain states, regulated commercial sportsbooks like FanDuel and DraftKings still dominate the online betting market, capturing an estimated 75% share. However, unlicensed offshore operators generated more revenue than both tribes and commercial platforms combined, with an estimated $67 billion in revenue last year.
